Morning World Saturday, April 10h I Texas Court Gives Estes 0 90-Day Stay AUSTIN, Tex. (AP) Billie Sol Estes won Friday a 90-day slay of a Texas Court of Criminal Appeals order that he be gin serving the eight-vear prison sentence given him on a swindling conviction. The court agreed to stay its mandate so attorney, John Cofer, could appeal the ease to the U.S. Supreme Court. On Wednesday, the court rcject- cf'i for the third time appeal from the Tyler swindling conviction, but allowed 15 days for one more appeal because an earlier opinion was reworded.

The stay keeps the sentence from being enforced before the Supreme Court decides to review' the conviction. Estes, 39. was convicted on 7, 1962, on state charges that he persuaded a farmer to sign a 594,500 chattel mortgage on nonexistent fertilizer tanks. The state alleged Estes built a multimiilion-dollar financial structure largely by discounting mortgage paper on fertilizer tanks leased from farmers who purchased them on lawyers contended he merely paid the farmers a cash bonus for lending their good credit. An El Paso federal court jury! convicted Estes on March 1963, on four counts of mail, fraud and one of conspiracy and assessed him 15 years in The conviction has been appealed but has not yet been argued.

Estes is free on appeal bonds totaling $140,000 on the two convictions, He now' lives in Abilene.
