Prosecutor Tony Clayton said the appeals court gave the district attorney's office until today to respond. As of Wednesday, the Louisiana Supreme Court had not ruled on the matter. Clayton said the defense was merely trying to delay the trial and he did not believe the appeals courts would grant the defense's motion. Associated Press PORT ALLEN Defense attorneys for serial-killing suspect Derrick Todd Lee are asking appeals courts to delay Lee's Aug. 2 trial date on a charge of killing an Addis woman.

The defense is challenging a judge's ruling prohibiting Lee from using the diary of murder victim Geralyn Barr DeSoto and statements from family and friends describing her unhappy marriage. Thompson asked the 1st Circuit Court of Appeal and the Louisiana Supreme Court to immediately consider the application or delay the trial until an appeal can be heard. A three-judge panel of the 1st Circuit, however, refused Tuesday to consider the application or request for a delay on technical grounds, saying certain parts of the application were not properly filed.
